

RoadSense NI has come together to support the need for competent, professional and qualified driving instruction, both for private pupils and for company fleets.
In the past few years the government has focused its attention on the growing number of road deaths and injuries caused by drivers whom are using company vehicles. As a result of this, a new criminal offence has been created. The law governing this is The Corporate Manslaughter and Corporate Homicide Act 2007 which came into force in the UK on the 6th April 2008.
Although this legislation demands no action to be taken, it does mean that should an accident (injury or fatality) be prosecuted by the Crown Prosecution Service, the investigation will also include a thorough audit of the companies Health and Safety policies as well as any other actions they may have taken to ensure public safety. If failures are found, or insufficient actions have been taken then an unlimited fine may be applied to the company as well as an order to publicize their error and its consequences, legal and otherwise. More importantly is the provision for the prosecution of individual or groups of senior management whom the court finds ultimately responsible. This could result in a charge of Gross Negligence Manslaughter which can carry a jail term of up to life imprisonment.
